White House says the "emergency" will end in May 2023. Is the USG allowed to redefine our language? More on liability shields
Merriam Webster defines emergency: 1. an unforeseen combination of circumstances or the resulting state that calls for immediate action 2. an urgent need for assistance or relief
The “Emergency” designation gives the federal and state executive branches dictatorial powers. It is also absolutely necessary if EUAs are to be used. The day the Emergency ends, all EUAs end—they get revoked.
Not only are the bivalent booster vaccines EUAs, but the original doses for younger children are too. So are ALL the several hundred PCR tests and antigen and antibody tests. So were the monoclonal antibodies—all of which have been ended by FDA (most recently the last one, Evusheld had its EUA revoked last week) because they don’t work for any existing variants. So are some of the drugs. Even masks had an EUA issued. Ventilators (not all, but some). This removed responsibility from every company making these products, distributors, injectors, labs, government officials, and the owners of buildings where vaccine clinics were held. This is what allowed untrained people to be made into vaccinators. Think about it—if an untrained National Guardsman or firefighter sticks a needle in the wrong place and you have a nerve injury (this is a real diagnosis called SIRVA) the lawyers already figured out how to prevent you from getting damages.
What happens in May? Schizer and Murderna will be allowed to sell their fully licensed COVID vaccines for over $100 per dose, instead of selling them to the government for $20-$30/dose.
By then the full process for removing liability for these products will be complete: a Federal Register notice and an excise tax of 75 cents/dose will have been completed and because CDC put the vaccines on the childhood schedule, the COVID vaccines will fall under the National Vaccine Injury Compensation Program (NVICP). A pot of money will become available to pay out for a limited number of injuries, collected from the excise taxes paid for all vaccines in the program. The USG and the manufacturer will again dodge liability.
Under an EUA, vaccine injuries fall into a separate vaccine injury program also administered by HRSA, part of DHHS. This program, the Countermeasures Injury Compensation Program (CICP) is a total joke.

* Most of these claims are COVID related, although this program is 13 years old. Only 14 of 11,065 COVID injury claims have had a positive determination so far, but it is interesting that the program does not claim to have paid out on a single one yet.
Has the CICP Made Any Decisions Regarding COVID-19 Claims?

As if this wasn’t bad enough, the program only pays for lost wages and unreimbursed medical expenses, up to a maximum of about $380,000. If you have adequate health insurance and disability insurance, the CICP (as the payor of last resort) will give you nothing, even if your claim is approved for compensation. It also pays no legal expenses or other expenses needed to produce a claim. And the only appeal is to an HHS bureaucrat who keeps their job by denying claims. There is no access allowed to the US legal system under CICP and EUAs.
Bet you weren’t told that when you got your so-called informed consent for these worthless, experimental products.
The NVICP is not as stingy as the CICP, and it pays out a higher percentage of claims. But still, most applicants walk away, after years in the system, with nothing.

HHS extends monkeypox emergency declaration, expands covered providers

Health and Human Services Secretary Xavier Becerra last week extended for 10 years his Aug. 4 public health emergency for monkeypox under the Public Readiness and Emergency Preparedness Act, and authorized additional providers to administer vaccines and therapeutics under the emergency declaration. The original declaration was effective through Dec. 31.
Authorized vaccine and therapeutics providers under the updated declaration include any dentist, advanced or intermediate emergency medical technician, licensed or certified professional midwife, nurse, advanced practice registered nurse, registered nurse, licensed practical nurse, optometrist, paramedic, pharmacist, pharmacy intern, pharmacy technician, physician, physician assistant, podiatrist, respiratory therapist, or veterinarian who is licensed or certified to practice in any state or has held an active license or certification under the law of any state within the last five years. It also includes students with appropriate training in administering vaccines or therapeutics as determined by their school or training program, and supervision by a currently practicing health care professional, among other requirements.
